City of Indian Wells Information Release

07/28/2015

On September 8, 2014, a severe storm settled over Indian Wells, which resulted in storm water levels that far exceeded the drainage and flood control infrastructure, causing damage to private property and facilities.  The City and FAMD do not own the golf course where the floodwaters flowed on their way to other private property. Neither the City nor FAMD altered the natural state of historic drainage flows.

Because of these facts, it is not appropriate to spend public tax dollars for improvements on private property.  Furthermore, for various legal and practical reasons, it is not feasible for the City or the FAMD to install improvements on property they do not own or control.

The flood damage from the September storm resulted in several claims for damages filed against the City, FAMD and others.  In addition to forcing the city to use limited public taxpayer dollars to defend ourselves from these claims, this serious threat of litigation also complicates the public discussion process and severely curtails meaningful dialog outside the legal arena.
